It a ruling certain to upset authors and creators, a federal judge ruled that Artificial Intelligence companies don’t need permission from authors to train their large language models (LLMs) on legally acquired books. Arstechnica.com reports that Judge William Alsup made the ruling this week. It remains an open question with regards to pirated books. The judge did allude to the plaintiffs’ weak argument, and noted that authors would be able to raise new claims if they found evidence of infringing Claude outputs. That could change the fair use calculus, as it might in a case where a judge recently suggested that Meta’s AI products might be “obliterating” authors’ markets for works. The piracy case is still pending, so stay tuned…this isn’t the end yet.

Meta’s Oversight Board is calling out the firm’s approach to manipulated media as being ‘incoherent.’ According to engadget.com, the board has been urging Meta to update rules since a misleading video of Joe Biden went viral on Facebook. Meta’s software apparently does a reasonable job of spotting and labeling AI images, but isn’t as good with audio or video clips that have been manipulated. Meta has even told the board that it can’t automatically identify and apply labels to audio and video posts, only to “static images.” The board said the company should adopt a “clear process” for consistently labeling “identical or similar content” in situations when it adds a “high risk” label to a post. 

With Elon Musk out of Trump’s inner circle and the two at an uneasy truce after publicly throwing criticisms and insults at the other, Jeff Bezos is apparently trying to worm his way in…reaching out to Trump. Bezos, who is very publicly in the middle of his high dollar wedding festivities in Venice, which have cause protests there, is more privately reaching out to Trump. TechCrunch.com notes that Bezos has spoken to the president twice this month, and is angling for more government contracts for his space company Blue Origin. Look for Bezos to be much more under the radar and not try to ‘co-star’ or act like a co-president to Trump…which will likely get him a lot further with the president before an inevitable falling out. If he can get the administration to go with Blue Origin on more space spending and take that away from Musk’s SpaceX in the meantime, he will have gotten what he wants.

As of now, if you order an UberX, Comfort, or Comfort Electric ride in Atlanta…you may see a Waymo vehicle showing up instead of a live driver. 9to5google.com reports that Uber is saying customers will aways have an option to switch to a non-AV ride before a car is dispatched. If you do choose the Waymo self-driver, you can unlock the car, open the trunk, and start your journey, all from the Uber app. Uber says 24 hour customer service is available. The driverless Waymo cars will operate in a 65 square mile area of Atlanta.

US and China Cut Tariffs-90 Days; Apple Considering Price Hikes for iPhone 17; Samsung Galaxy Z Flip 7-Bigger Outer Display; OpenAI & Microsoft Renegotiating Partnership

It what may have been the most telegraphed alleged deal in a long time, the Trump administration and China have issued a joint statement cutting tariffs for the next 90 days. Theverge.com reports that the Trump US import tax on Chinese goods drops from 145% to 30%, while China will reduce theirs from the 145% down to 10% on what they import from the US. In the next 90 days, the two nations will continue to work to finalize a trade deal. 

Apple is looking to hike iPhone 17 prices this fall, claiming it has nothing to do with the Trump tariffs. According to macrumors.com, Cupertino plans to try to justify the increases in cost by touting new features and design changes. It may be something of a big lift to convince people that the tariffs have nothing to do with it…even though Apple had already planned to import most iPhones from India instead of China to get around the heavy tariffs. Apple hasn’t raised prices notably on iPhones in a while, so really they were probably due for an increase anyway…but you know people will still blame the Trump import tax anyway.

A new leak points to the Samsung Z Flip 7 getting a bigger cover display…similar in size to the one on the Moto Razr. Androidpolice.com notes that even with the bigger screen, there aren’t any planned new usability features for the outside screen. That means they still won’t directly run apps on the outer screen. You can utilize a Good Lock module to increase functionality. The change in size isn’t dramatic, but at least it will be a head to head match with a main competitor. 

OpenAI and Microsoft are revamping their partnership, with Microsoft reducing its equity state in OpenAI in exchange for extended access to OpenAI’s technology beyond the previously agreed upon 2030 cutoff. Geekwire.com reports that the changed deal will also make a future IPO for OpenAI possible. Microsoft has plowed over $13 billion into OpenAI since 2019, and it provides computing capacity for OpenAI’s services. Microsoft uses OpenAI tech for Microsoft Copilot. OpenAI will continue with its restructuring to create a for-profit public benefit corporation, controlled by its nonprofit parent.

We have just gotten a whiff of rumors now, but macrumors.com reports that in an exclusive out today from The Information, Apple is allegedly working on a foldable iPhone similar to the Galaxy Z Flip. Apple has been on the prowl now for months, looking for suppliers in Asia, and now is moving forward with the project. The Apple foldable is being code named V68. Up to now, Apple has had interest in a folding iPhone, but hasn’t been happy with the crease where the screen folds. We’ll see if they are able to overcome this, or if we will see a folding iPhone by 2026. 

The European Union is threatening Meta for saying Facebook is free in the EU. According to theverge.com, the EU has told Meta that their ‘pay or consent’ model for Facebook and Instagram may violate consumer protection laws. They have given Meta until September 1st to propose changes to its model which they call ‘misleading’ and ‘confusing’ for users. If Meta doesn’t hit the deadline, it gets hit with big fines. Meta has responded with a statement saying “Subscriptions as an alternative to advertising are a well-established business model across many industries. Subscription for no ads follows the direction of the highest court in Europe and we are confident it complies with European regulation.”

Three lecturers at University of Glasgow in Scotland have published a paper in the journal of Ethics and Information Technology, and have also covered it in a Scientific American article. The paper is titled ‘ChatGPT is Bullshit.’ After laughing and agreeing, I read further. The professors say there are actually bullshit distinctions…there’s general bullshit, hard bullshit, and soft bullshit. Cnet.com says the scholars argue that calling AI lies hallucinations is not accurate, saying ”Because these programs cannot themselves be concerned with truth, and because they are designed to produce text that looks truth-apt without any actual concern for truth, it seems appropriate to call their outputs bullshit. We think this is worth paying attention to.” They go on to write “Among philosophers, ‘bullshit’ has a specialist meaning, one popularized by the late American philosopher Harry Frankfurt. When someone bullshits, they’re not telling the truth, but they’re also not really lying. What characterizes the bullshitter, Frankfurt said, is that they just don’t care whether what they say is true. ChatGPT and its peers cannot care, and they are instead, in a technical sense, bullshit machines.” 

Google has now given up on plans to depreciate third party cookies on Chrome. According to androidauthority.com, the little trackers that make targeted ads possible will be sticking around. Google had said back in 2020 they would revise Chrome’s user privacy, but after several delays, they have apparently killed the whole idea. Money talks.

Things just keep looking worse for Facebook when it comes to protecting user data. Businessinsider.com says a Facebook engineer warned the company in 2014 about a potential giant data issue involving Russia. This info is coming out after the British Parliament got hold of a cache of sealed Facebook documents. UK politician Damian Collins, who reviewed the documents, made the disclosure today at a hearing in front of the International Grand Committee. Mark Zuckerberg refused to show for the hearing, sending policy chief Richard Allen. Allen if this information had been given to an external body (like an agency of the US government) at the time. Allen refused to answer. The documents are sealed under court order in California, but they were published in the United Kingdom under UK parliamentary privilege.

A couple months back, a panicked friend told me ‘My phone is my life,’ as it was temporarily missing. That is more true that ever now. Cnet.com reports that total sales on smartphones through Cyber Monday was $2.2 billion, up from $1.4 billion last year! On Cyber Monday, phones accounted for 47% of traffic to online stores and 36% of actual sales. Overall Cyber Monday sales were $7.9 million, so the mobile component was substantial. Since the 1st of November $50.6 billion has been spent online, up 20% from last year!

Amazon has announced its 5 best sellers on Black Friday and Cyber Monday. Topping the list, according to bgr.com, the Amazon Echo Dot at $29.99 instead of $50 In the #2 spot, AncestryDNA: Genetic Testing Ethnicity (still on sale at $59 btw). The third place seller was the adored Instant Pot DUO60 6 Qt 7-in-1 Multi-Programmable Pressure Cooker…still at $30 bucks off. Bose Quiet Comfort 25 Acoustic Noise Cancelling Headphones bagged the 4th place spot…and those are now sold out. #5 was Michelle Obama’s new book Becoming, which is still available at a $20 discount.

Yesterday, Donald Trump threatened to slap a 10% tariff on iPhones and MacBooks imported from China, and the stock acted accordingly. Today, Tim Cook is visiting an Idaho school district with Ivanka Trump to talk tech. Coincidence? I doubt it. So far, Cook has gotten Trump to lay off Apple products. Macrumors.com says in 2016 Apple donated an iPad to every student, a Mac and iPad to every teacher, and an Apple TV to each classroom via its ConnectED initiative. Will a ‘charm trip’ with Ivanka keep tariffs off Apple products again? Stay tuned.

Chinese smartphone maker Huawei has slipped past Apple to grab the #2 spot in smartphone sales. TechCrunch.com reports that a Gartner figure puts Huawei ahead in sales for the 2nd quarter. Huawei came in at 13.3%, up from 9.8% in the prior year, while Apple got 11.9%, off slightly from the 12.1% they had in 2017’s Q2. Samsung still stands tall as #1, at 19.3% this year, and 22.6% in 2017.

Facebook has announced they will cut greenhouse gas emissions by 75% and be running on 100% renewable energy by the end of 2020. According to theverge.com, Facebook has signed contracts for more than 3 gigawatts of new solar and wind energy since 2013. Those projects are all on the same grids as Facebook data centers in Oregon, Virginia, New Mexico, and Sweden. Samsung has also pledged to be on 100% renewable by 2020 in the US, Europe, and China. Apple and Google have also purchased enough renewable energy to offset their global energy consumption since April.

Oculus is getting ready to study how virtual reality can be used in education. Cnet.com says they have kicked off a pilot program called Oculus Education, which will distribute Oculus Go and Rift headsets to schools, libraries, and museums in Taiwan, Japan, and Seattle. The first phase will center around training teachers and other instructors in the use of VR and gathering feedback, and how VR can fill unique needs in those institutions. In conjunction with the headset program, Oculus is releasing 3 new VR experiences centered around history, science, and culture. They are all available at the Oculus store.

Toyota is pumping $500 million into Uber as part of a self-driving car partnership. Businessinsider.com reports that Toyota had previously invested in Uber a couple years ago as part of an auto leasing deal. Uber is reportedly selling self-driving tech to Toyota, while Toyota is promising to collaborate with Uber in moving self-driving tech forward. We may be seeing a Toyota self-driving Prius Hybrid sooner, not later.

Donald Trump fired off another angry Tweet from the White House…this time accusing Google of rigging search results against conservatives. According to gizmodo.com, the Chief Executive Tweeted “Google search results for ‘Trump News’ shows only the viewing/reporting of Fake New Media. In other words, they have it RIGGED, for me & others, so that almost all stories & news is BAD. Fake CNN is prominent. Republican/Conservative & Fair Media is shut out. Illegal?” He is claiming that ’96% of the results on ‘Trump News’ are from National Left-Wing Media, very dangerous.’ He went on to rail that it was a very serious situation and it will be addressed. It might help if he adjusted his view of ‘Fake News.’
